FAIL TO COMPLY WITH UNDERTAKING

Cornwall, ON- James Spencer, 40 of Cornwall was arrested on February 25th, 2013. He was bound by an Undertaking with the relevant conditions not to associate with anyone known to use or deal in drugs and to keep the peace and be of good behaviour. It is alleged that on February 25th, 2013 shortly prior to 3:00 pm he was observed by a member of the Cornwall Community Police Service Community Patrol Division to be in the company of a male known to be involved with drugs. He was charged with 2 counts of Fail to Comply with Undertaking and released to appear in court on April 2nd, 2013.

    I think this is a stupid charge. Just because you may be on the same street or sidewalk as someone doesnt mean you were in their company and also how are you supposed to know if someone is involved with drugs????? I dont have a record but I sure dont go up to everyone I meet and ask them if they do!!! And what if it was someone you hadnt seen in a long time, are you gonna ask them if they have a record????? Just because someone has a record doesnt necessarily mean that they are a "criminal" and go around breaking the law all the time and even those people that do, they dont go around discussing it all the time. Anyway, just wanted to express my view on this....unless we are all forced to wear big signs stating our criminal record, or lack of, I dont think its fair to be accused of knowing someone has a record or not!!!!!!!
